The 1,600-member Managed Funds Association has long advocated for a loosening of the SEC's restrictions on hedge fund advertising. Now, Phil Goldstein is threatening to sue the SEC on First Amendment grounds, which could be the action that changes everything. After all, Goldstein is the plaintiff who single-handedly defeated a plan to require hedge funds to register with the SEC.
Please join us as Goldstein and Allensworth discuss the following issues:
- Will Goldstein sue or will the SEC agree to take no action if he revives his Bulldog Investors website?
- What is meant by allowing hedge funds to publicly advertise? What are the various options?
- What are the benefits of permitting hedge funds to provide more information to the public?
- How might the business change if hedge fund advertising is permitted?
- Also including an update on Phil Goldstein's application for an exemption from filing Form 13F (on Fifth Amendment grounds).
